Q&A with an ALHS Attorney
What happens when a stepmother refuses to turn over the will of a deceased father? Recently a daughter was asking for the will but her stepmother wasn’t cooperating. What are the daughter’s rights?
Jim Anderson:
The law requires that the person who has the original will deliver it to the court. If the stepmother intentionally does not deliver the Will, she is liable for damages. That means that if additional legal expenses are generated by the daughter because she is trying to get the Will into the court, the stepmother may be responsible for payment or any other harm that occurs due to the stepmother’s intentionally withholding the Will. The daughter could ask the court to issue an Order demanding that the stepmother bring the Will to the court. The Court could then issue a penalty if the stepmother fails to cooperate.
